Site Terms, Privacy and Consent

These terms, the privacy policy and the consents below apply to drocdesmo.com, our membership registration and our online communications. They are written by DROC, for DROC. They do not come from, and do not speak for, any motorcycle manufacturer or other company.

1. About these terms
Who we are. The site is operated by WE ARE DROC, a California nonprofit mutual benefit corporation doing business as Ducati Riders of Orange County (“DROC”, “we”, “us”). DROC is an independent, volunteer-run social club of motorcycle riders based in Orange County, California. Our contact details are in section 10.
Independence and trademarks. DROC is not owned by, controlled by, or an agent of Ducati Motor Holding S.p.A. or any other manufacturer, dealer or brand. Ducati, the names of Ducati models, and related names, logos and designs are trademarks of their owners. We use them only to describe the motorcycles our members ride and the programs we take part in. Nothing on this site is an endorsement by, or a statement from, those owners. Where DROC takes part in a manufacturer or partner program, that program has its own terms, and those terms apply to you for that program.
Related documents. Participation in DROC rides and events is governed by the signed General Waiver and Release and by any event-specific waiver, not by this page. The event disclaimer explains what that means in plain language. If this page and a signed waiver ever conflict about risk, release or liability for an activity, the signed waiver controls.
2. Terms of Use
2.1 Acceptance
By using the site you agree to these terms. If you do not agree, do not use the site. By creating an account, registering as a member, or submitting a form, you also agree to the sections that apply to that action.
2.2 Eligibility
You must be at least 18 years old to create an account, join DROC or take part in DROC rides. Younger visitors may read the public pages with a parent or guardian. See children and minors.
2.3 Accounts and members-only content
- Give accurate information and keep it current.
- Keep your password private. You are responsible for activity under your account. Tell us promptly as described in section 10 if you suspect misuse.
- Members-only pages, event details and member directories are for members. Do not share, republish or scrape them.
- We may approve, suspend or end membership and account access under our club rules and these terms.
2.4 Acceptable use
You agree not to:
- break any law or the rights of others, including privacy, publicity and intellectual property rights;
- harass, threaten or defame anyone, or post hateful, obscene or deceptive material;
- send spam or use the site or member lists for advertising or solicitation without our written permission;
- probe, scan, overload or attempt to break the security of the site, or use bots or scrapers to collect data;
- impersonate another person or misstate your affiliation with DROC;
- use the site for commercial purposes without our written permission.
2.5 Your content and license to us
If you submit text, photos, video, comments, ride reports or other material (“User Content”), you keep ownership. You grant DROC a non-exclusive, worldwide, royalty-free license to host, reproduce, adapt, display and distribute that content on the site, in our newsletters, and on our social media and club channels, for the purpose of running and promoting the club. This license continues for content already published or shared until it is removed, and for reasonable archival copies. You confirm that you own the content or have permission to share it, and that it does not infringe anyone else’s rights. We may remove any User Content at our discretion. Photo and video of you taken at events is covered separately in section 6.
2.6 Our intellectual property
The site design, text, graphics, logos, posters, maps and other DROC-created materials are owned by DROC or its licensors and protected by copyright and trademark law. You may view them and share links for personal, non-commercial use. You may not copy, modify or redistribute them without permission. “DROC” and our logos are marks of DROC. Third-party marks belong to their owners, as stated in section 1.
2.7 Third-party links and partner offers
The site links to services we do not control, including payment processors, forms, maps, social networks, venues, dealers, track operators and partner businesses. Partner offers and discounts are made by the partner, not DROC. We do not control or endorse third-party sites, we are not responsible for their content, products or privacy practices, and your dealings with them are between you and them.
2.8 No professional or safety advice
Ride descriptions, routes, maps, gear tips, track information and other content are for general information. They are not professional, mechanical, legal, medical, financial or safety advice. Conditions change. Check them yourself before you ride, and make your own decisions about your skills, your motorcycle and the conditions.
2.9 Assumption of risk
Motorcycling and group riding are dangerous and can cause serious injury or death. Using this site does not release any claim and does not replace the signed waiver. The risks of taking part in DROC activities, and the release you give for them, are set out in the General Waiver and Release.
2.10 Disclaimer of warranties
THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE. EVENT DETAILS, DATES, ROUTES AND PRICES CAN CHANGE.
2.11 Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, DROC AND ITS OFFICERS, DIRECTORS, VOLUNTEERS AND MEMBERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA, ARISING FROM YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM ABOUT THE SITE WILL NOT EXCEED $100 OR THE AMOUNT YOU PAID US IN THE PRIOR 12 MONTHS, WHICHEVER IS GREATER. Some jurisdictions do not allow certain limits, so some of this may not apply to you. Nothing here limits liability that cannot be limited under California law, including for fraud, gross negligence or willful misconduct, and nothing here changes the waiver you sign for activities.
2.12 Indemnification
You agree to defend, indemnify and hold harmless DROC and its officers, directors, volunteers and members from claims, losses and reasonable attorneys’ fees arising from your User Content, your misuse of the site, or your breach of these terms, to the extent permitted by law.
2.13 Changes to these terms
We may update this page. We will post the new version with a new “last updated” date and, for material changes affecting members, tell members by email. Continued use after the effective date means you accept the changes. Changes do not alter a waiver you have already signed.
2.14 Termination
You may stop using the site or close your account at any time by contacting us. We may suspend or end your access at any time, with or without notice, for violating these terms or the club rules, or to protect the club or others. Sections that by their nature should survive, including ownership, disclaimers, liability limits, indemnity and disputes, survive termination.
2.15 Electronic communications and signatures
You agree that we may give you notices, disclosures and agreements electronically, by posting on the site or by email, and that these satisfy any legal requirement that they be in writing. You agree that your electronic signature, including clicking an “I agree” button or submitting a form, has the same legal effect as a handwritten signature, consistent with the federal ESIGN Act and the California Uniform Electronic Transactions Act. You may ask for a paper copy, or withdraw this consent for future notices, by contacting us, though withdrawing may end your ability to use online membership services. You need a device with internet access, a current browser and a working email address to receive electronic records.
2.16 Copyright and trademark concerns
The site does not generally host material posted by the public. If you believe something on the site infringes your copyright or trademark, contact us as described in section 10 with the exact URL, a description of your work or mark, and your contact details. We will review it promptly and remove material that we determine infringes.
2.17 General
These terms, together with the signed waiver, our club rules and any form you submit, are the entire agreement between you and DROC about the site and replace earlier versions. If a provision is unenforceable, the rest stays in force. Our failure to enforce a provision is not a waiver of it. You may not assign these terms; we may. These terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Subject to section 9, the state and federal courts located in Orange County, California have exclusive jurisdiction, and you consent to them.
3. Privacy Policy
This policy explains what personal information DROC collects through the site and club operations, why, who sees it, and what choices you have. It is written to meet the California Online Privacy Protection Act (CalOPPA).
3.1 What we collect
- Identifiers and contact details: name, email address, phone number, postal address, username and password, emergency contact name and phone.
- Membership and event records: membership status and dates, event RSVPs and attendance, dues and event payments (see payments below), motorcycle make and model, license plate where you give it.
- Waiver records: your signed waiver, date of birth, a photo for identity confirmation, signature, and the date, time and IP address of signing.
- Content you send us: messages, form responses, photos, comments and ride reports.
- Technical data: IP address, device and browser type, pages viewed, referring page, and approximate location derived from IP, collected through cookies and similar technology.
- Photos and video of you taken at events, if you attend (section 6).
We do not knowingly collect Social Security numbers, driver license numbers, precise geolocation or health information through the site. Emergency contact details and any medical information you choose to tell a ride leader are used only for emergencies.
3.2 How we use it
- run memberships, rides, events and the club;
- confirm eligibility, process payments, and keep waiver and attendance records;
- send membership, event and safety communications you are entitled to or have agreed to (section 5);
- respond to you, and keep the site secure and working;
- understand site use and improve it;
- promote the club using event photos and video, as described in section 6;
- comply with law and protect the club’s rights.
We do not sell your personal information for money. We do not use it for targeted advertising, and we do not use it for automated decisions that significantly affect you.
3.3 Who we share it with
We share information only as needed to run the club, with service providers who act for us, and when the law requires. The providers we use today are:
- Hosting and caching for the website, from our web hosting provider;
- Stripe for card payments. Card numbers go to Stripe, not to DROC, and Stripe’s privacy policy applies to that data;
- Jotform for waivers and some forms, including stored signatures and uploads;
- Mailchimp for email newsletters and announcements;
- Google for site analytics (Site Kit, Google Analytics) and reCAPTCHA spam protection on forms;
- Telegram if you join our club channel or group, where your username and messages are visible to other members under Telegram’s terms;
- Instagram, Facebook and YouTube where we post club content and embed it on the site, under their own policies;
- Google Workspace for club email, calendars and member records;
- Event hosts, venues, track operators and partner businesses, only when needed for a specific event you register for, such as a head count or entry list, or when you consent (section 7);
- Professionals and authorities: our insurer, attorneys and accountants, and courts or agencies when legally required;
- A successor if the club merges, reorganizes or dissolves, subject to this policy.
We do not share your information with other members except what you choose to show, for example in a member directory if the site offers one, and the event attendance lists used on rides.
3.4 Cookies, analytics and tracking
The site uses cookies and similar technology to keep you logged in, remember preferences, protect forms, and measure traffic. Analytics are provided by Google Analytics through the Google Site Kit plugin. Google reCAPTCHA runs on registration and payment forms. Embedded social posts and videos can set their own cookies once you interact with them. You can block or delete cookies in your browser settings, though login and forms may stop working. You can opt out of Google Analytics with the Google browser add-on.
3.5 Do Not Track and Global Privacy Control
Some browsers send a “Do Not Track” signal. There is no common standard for it, and the site does not currently change its behavior in response. The site does not currently respond to Global Privacy Control signals either. We do not sell your personal information or share it for cross-context advertising, so there is nothing to opt out of, and you can contact us at any time with a privacy request. We do not allow third parties to collect information about your online activities across other sites through our site, other than the analytics and embedded services listed above.
3.6 Your choices
You can ask us what personal information we hold about you and why, ask for a copy, ask us to correct anything that is wrong, or ask us to delete it. Logged-in members can review and update their profile on the site. For anything else, contact us as described in section 10 from the account you registered with, or give us enough details for us to confirm it is you. We will respond within 45 days. We may keep records we are required by law to keep or need to defend a claim, in particular signed waivers (section 3.8), and we will tell you if we cannot fully act on a request, and why. You can stop club emails at any time with the unsubscribe link. Someone may act for you with your written permission.
3.7 Security
We use reasonable administrative, technical and physical safeguards, including HTTPS, access limits, and reliance on payment and form providers with their own security programs. No method is perfectly secure, and we cannot guarantee absolute security. Choose a strong, unique password. If a breach affects your information, we will notify you as California law requires.
3.8 Retention
We keep information only as long as needed for the purposes above. Current periods: signed waivers and their sign-in metadata, seven years; membership records, for the life of membership plus three years; payment records, seven years for tax and accounting; newsletter subscription data until you unsubscribe; website logs and analytics, 14 months; event photos and video, until removed on request (section 6). We then delete or anonymize it.
3.9 Children under 13 (COPPA)
The site is not directed to children under 13, and we do not knowingly collect personal information from them. If you believe a child under 13 has given us information, contact us and we will delete it.
3.10 Children and minors
Membership and riding are limited to adults 18 and over. Minors may attend non-riding events with an accompanying adult, as the waiver describes. We collect information about a minor only from the accompanying adult and only as needed for that attendance. A parent or guardian may ask us to review or delete it.
3.11 Changes to this policy
We will post changes here with a new date, and tell members by email if a change is material. Collection after a change follows the updated policy.
4. California notices
Shine the Light (Civil Code section 1798.83)
California residents may ask once a year what categories of personal information we disclosed to third parties for their direct marketing, and to whom. We do not disclose personal information to third parties for their own direct marketing. To confirm, contact us as described in section 10 and mention “California Shine the Light”.
California consumer complaint notice (Civil Code section 1789.3)
If you have a question or complaint about this site, contact us as described in section 10. California residents may also contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N-112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
5. Email and Telegram consent
Email. When you join, RSVP or subscribe, you agree that DROC may email you about your membership, events, safety and club business. Members receive club announcements as a membership benefit. Every marketing email carries a working unsubscribe link, our physical address and accurate sender details, as the CAN-SPAM Act requires. We honor unsubscribe requests within 10 business days. Account, payment and safety messages may still be sent after you unsubscribe from newsletters.
Telegram. The club announcement channel and any groups are optional. Joining is voluntary and under Telegram’s terms and privacy policy. Group members can see your display name, username and posts. Leave the channel at any time.
Changing your mind. You can withdraw consent any time by using the unsubscribe link, leaving the Telegram channel, or writing to us.
6. Photo and video release
DROC rides and events are photographed and filmed, by our volunteers and sometimes by hosts, venues and partners. By attending, you understand that you may appear in photos and video taken in public or semi-public settings at DROC activities. Where you have ticked the optional photo and video consent on the signed waiver, or otherwise tell us you agree, you give DROC permission to use photographs and video of you from DROC activities, without compensation, on the website, newsletter, social media and club promotional material. This consent is optional and is not a condition of taking part. We will not use a photo to state or imply that you endorse a product or business. To ask us to stop using or remove a photo of you, contact us as described in section 10 with the photo link or a description. We will remove it from our own channels within a reasonable time. We cannot recall copies already shared or reposted by others. Minors’ photos are published only with an accompanying adult’s agreement.
7. Membership data sharing
DROC shares only what is needed, and only for a stated purpose. If you take part in the manufacturer-run Official Club program, DROC tells Ducati that you are a member of the club. Ducati already holds the information you gave it directly when you registered with the program, and its own terms and privacy policy govern that information. For dealer events, discounts and other partner offers, we share your name or contact details with a partner only if you ask us to or give your consent for that purpose, and only the fields that purpose needs. We do not give partners our member list for their own marketing. Once information reaches a partner, that partner’s own terms and privacy policy govern its handling. You can withdraw consent at any time by contacting us, which stops future sharing but cannot recall information already provided.
8. Accessibility
DROC wants the site to work for everyone, including people with disabilities. We aim to follow the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA as far as a volunteer-run site reasonably can, and we fix problems as we find them. Some older pages, embedded third-party content and PDFs may fall short. If you have trouble using any part of the site, or need information in another format, contact us as described in section 10 and describe the page and the problem. We will respond within 15 business days and give you the information another way while we fix it.
9. Disputes
If you have a concern, contact us first as described in section 10 and give us a chance to resolve it informally for 30 days. Claims not resolved informally are subject to the governing law and venue in section 2.17.
